On Wednesday, Nov. 25, the board for the KWA voted for Greg Alexander as chairman and Jamie Curtis as its vice chairman. Alexander is the Sanilac County drain commissioner, and was the vice chairman for the past few years under former Flint Mayor Dayne Walling, who was the chairman. Proposed Water Line Relocation

Chris, The GCDC-WWS is planning to realign the portion of the 36-inch City of Flint raw water line and 48-inch GCDC treated water line that were originally permitted for wetland and stream impacts along Stanley Road between Marathon Road and German Road in Oregon Township, Lapeer County. The previously permitted impacts for this section of water line include wetland Impacts 59 and 60 as included in MDEQ Permit No. 13-25-0060-P and stream Impact 58 as included in MDEQ Permit No 15-44-0016-P. The previous permit allowed for temporary wetland impacts and replacement of the Stanley Road crossing over the Henry Drain including cofferdams, rip rap and SESC BMP’s. At this point, GCDC-WWS is planning to change the alignment for this reach of pipe as show by the red line on the attached location map, and as shown in more detail on the attached construction drawing. The need for GCDC-WWS to revise the alignment is due to (1) poor soils conditions found along the originally proposed route within the Stanley Road right-of-way, (2) the costs associated with providing piles and saddles to support the water main through the areas of poor soils and (3) to reduce the potential of unexpected impacts associated with working in poor soils. Somat Engineering, the geotechnical consulting firm hired by GCDC-WWS, performed a number of soil borings along the originally proposed route and found that poor soils, including but not limited to loose silty sand, fibrous peat, and organic clay, were encountered on both sides of the road and extended about 19 to 29 feet below the proposed pipe invert elevations. Based on these findings, the water line was originally designed to be supported on an extensive and deep foundation system. However, when GCDC-WWS received several bids from Contractor's to perform the work, the costs were found to be approximately 3 times higher than in other areas of the project. As a result, the GCDC-WWS developed this alternative to move the water lines away from the area of poor soils and eliminate the need for a considerable support system. The GCDC-WWS has obtained easements for this proposed realignment. The proposed realignment would now extend from the intersection of Marathon and Stanley Roads west approximately 1300 feet, where it would then turn south in a private easement and extend approximately 1400 feet, before turning west, again in private easements, and extending approximately 3250 feet. The 36" water main would then turn north and proceed another 1250 feet to the right-of-way at Stanley Road, where it will then turn west and extend another 200 feet where it will then be connected to the existing 36" water main that was installed as part of the S-4007 project that was previously constructed by the Karegnondi Water Authority. The 48" water main would continue west, approximately 3250 feet, where it would connect to the S-5005 project to be constructed by the GCDC-WWS. The route of the proposed realignment was reviewed by Mike Nurse of Streamside Ecological Services for regulated streams and wetlands. It was identified that additional wetland complexes or streams significantly beyond those addressed in prior permit application will be not impacted with the proposed realignment. The re-alignment will result in significantly less wetland impact overall. The originally permitted route along Stanley Road crossed through Wetland Impacts 59 and 60, which were classified as emergent/ scrub shrub wetlands. The total temporary wetland disturbance associated with these wetland Impacts was 0.45 Acres. With the proposed realignment, the GCDC is requesting temporary impacts of 0.15 acres for the renamed Impact 59-REV1 and Impact 59-REV2. Attached is a comparison table that illustrates the proposed realignment that reduces the amount of disturbed wetland area by 0.30 Acres. Wetlands Impacts 59-REV1 and 59-REV2, as shown on the attached plan and profile sheets, are classified as emergent/forested (EM/FO) wetlands. Areas of forested wetlands are located within County Drain right-of-way. The GCDC is proposing wetland plantings as shown on the attached wetland restoration table, which outlines the type and quantity of trees/shrubs that are specified for restoration. xxxEND_PAGE:deq16_b5_0892_4900_0041 The water lines also crossed the Henry Drain at a location approximately 1500 feet upstream of the location previously permitted. The water lines are proposed to be installed across the Henry Drain using open cut methods, including installation of a temporary cofferdam for water control. The stream will be stabilized in accordance with the stream utility crossing detail (attached). The overall footprint of the stream crossing will be reduced from what was prior permitted and the time frame for installation will be less, since this realignment does not require a culvert replacement, thus significantly reducing construction time. The construction schedule for the proposed realignment in proximity to the regulated stream and wetlands is March and April of next spring. This is also an optimal time for minimizing impact to fish and wildlife. It is also critical as this is the last section of water line to be installed to get a high quality raw water supply to the City of Flint. When we last spoke about this, you indicated that a permit application for a new individual permit would be required. The GCDC is asking that you complete an initial review of the proposed realignment and discuss with the GCDC-WWS permitting avenues to meet the proposed construction timeline of March and April of next year. It has been our experience that permit revisions are common, providing impacts are the same or reduced. The GCDC is of the opinion that the overall impacts to streams and wetlands has been reduced with this realignment plan, the construction schedule is optimal, the realignment reduces the risks of unknown impacts that may arise from construction in poor soils, it is a cost effective approach and it is critical to complete this line to deliver raw water to the City of Flint. Preliminary & Deliberative, not subject to FOIA - Norway Lake Road widening for KWA

Mike, As | mentioned, in August of 2014 | learned that the Lapeer County Road Commission (LCRC) had requested that the KWA widen Norway Lake Road through the Lapeer State Game Area (LSGA) after KWA installs the pipeline in the road. The attached letter from Larry Osborn (WadeTrim on behalf of the KWA) to Jennifer Olson (DNR) describes the request. There are at least two components of this work that could substantially slow progress in constructing the KWA line through the LSGA. The first is that the state (DNR) apparently owns the land on which the added road width would be placed. Typically, 1 xxxEND_PAGE:deq16_b3_0014_0687_086 these lands are purchased using federal dollars and the federal government seeks compensation if the lands are no longer used for fish and wildlife habitat. Also, the centerline of the road may not match the centerline of the ROW, which could further complicate matters, especially if the LCRC requires that the road be moved to match the ROW (or vice versa). The DNR's response to Mr. Osborn's letter will probably address these issues. However, as a point of reference, it took 10 months for the DNR to grant the KWA a permanent easement at another location on the route. The second complication is that much of land beside Norway Lake Road through the LSGA is forested wetland that is protected under Part 303, Wetlands Protection, of the NREPA. As | advised KWA representatives in August of 2014, the expansion of the roadway into wetland will need to be addressed under a new permit application. Although there is a minor project (MP) category for limited wetland fills for transportation safety purposes, it is likely that the additional wetland fill in this case will exceed 0.1 acres or otherwise fail to meet the MP criteria. That means that the DEQ's Water Resources Division (WRD) would have to prepare and issue a public notice, which opens a 20-day public comment period. The Lansing District WRD staff are currently backed up in our permit processing due to the roll-out of the MiWaters system on top of the normal heavy load of summer permit application. It is likely that we would need the full 120 days allowed for in statute to process this application. Further, if an affected party (say the LCRC) requested a public hearing on the permit application, we would be allowed an additional 60 days in which to hold a hearing and assess the public comments from the hearing and the 10-day post-hearing comment period. All of this assumes that the KWA doesn't require time to provide additional information after they submit their permit application. Additionally, and perhaps more importantly, it is likely that this permit application would require a (concurrent) federal review. The EPA has generally been submitting its comments near the end of their 90-day review period, which starts when they receive our Public Notice and thus, typically, corresponds with our 120th day. Also, it is likely that the KWA will have to mitigate (at 2:1) for all permanent wetland losses, which will, ata minimum, increase the cost of the project. It may also slow the process down as KWA will need to either purchase credits in a wetland mitigation bank or design and build its own mitigation wetland. I’ve been out of the office for a week. Violation letters were on my agenda before then. !am in process of writing violation notices for two sections of the project right now. | have a xxxEND_PAGE:deq03_b220_0337_0340_2 lot of concern that the contractors are barreling through with pipeline installation and not installing SESC measures where needed and not completing restoration in a timely manner. | met with our road commission engineers in mid - August, as they have taken a lot of complaints about road conditions. | wrote a violation notice for the section on Clear Lake Rd then. And the contractor immediately started working on the restoration issues. So | thought we were moving in the right direction. Now | am seeing my staff’s inspections for both sections/contractors with big problems. My staff have recently taken photos of areas where no SESC measures are installed on Clear Lake and King Mill Rds. 1’ll be recommending pipeline installation cease until SESC measures are installed where needed and restoration has caught up. I’ve not once heard from Spicer. --- Or seen a Spicer person on any site. Hi Chris, | also heard from Joe Suma that there are stretches of the KWA line in Lapeer County that have not been stabilized and there are SESC concerns. | don’t know specifically where, but | thought | would give you a heads up. It sounds like the CEA isn’t getting compliance, for whatever reason. He mentioned that the County Road Commission may have some success with preventing them to continue in their ROW until they stabilize the areas they already impacted. Hi Chris- Thanks for the heads up about this meeting concerning Norway Lake Road at Laneer State Garne Area. i'm assuming this is ali related to the water pineline project? If the Lapeer County Road Commission is requesting a wider roadway, Wildlife Division will need to know if they will be working outside of their existing right-of-way and/or if they require a permanent easement. The land along Norway Lake Read was purchased with Pittmar-Robertson Funds and thus requires US. Fish & Wildlife Service approval by the Minnesota office for any perrnanant conveyance of rights inland. NEPA chocumertation is required. Pve attached the funding source map for Lapeer County far your information. The Genesee County Drain Commission (GCDC} did receive approwal and a permanent easement (350 long x 40’ wide} for the pipeline crossing of the South Branch of the Flint River along Norway Lake Road (south side of the road). The easement is attached. That process tank about 10 months. it would be best if we could avoid going through this process again. When we met with GCC, all indications were they would be able to install the pineline within the existing road ROW. Piease let me know if there are any questions. The irnpetus for the meeting, which is slated for tomorrow afternoon, is that the road through the Lapeer State Garnes Area is narrow (S-foot lanes} and the Lapeer County Road Commission (now) wants it widened to meet currant standards (11-foot lanes plus shoulder), About 7,600 linear feet of roadway are under discussion, if the entire expansion is into wetland, ft would ervtail nearly 4 of an acre of additional permanent wetland impact. However, any additional permanent wetland iripact will require a new perrnit application, | will have more details after the meeting and will keen you in the loop. in the meantime, your thoughts are welcome. Importance: High Pete, Matt Raysin with the Genesee Courty Grain Commissioner's office contacted me last Friday to set up what | take to be a pre-annlication meeting regarding the proposed weter line from Lake Huron to Flint. He said that stat? from Spicer might be trying to set up the same meeting, but! haven’t heard fram thern. He clearly would like to meat as soon as possible, Mr. Raysin noted that the pipeline will be built under 7 contracts and wanted to know whether it would be better to subrnit a perrnit application for each cortract. He also told me that the project wauld be entirely in Sanilac, Lapeer, and Genesee Counties, but the drawing he subsequently sent (attached) shows the route along the St. Clair/Sanilac line with adip south into Brockway and Lynn Townships funless the alternate route to the north is used}. The drawing is alse ambiguous with regard to the actual water intake structure in Lake Huron, which they may be handling separately. Ltolo Mir. Raysin that we still needed to figure aut how we would process the anplleation, but noted that it would be cleanest if there was a single permit application and a primary person on each side of the table. The bulk of the Hine is in the Shiawassee/Lansing District, but the proposed work may involve Part 325 and/or the Corps, while this District does not have any Great Lakes shoreline.
