GOVERNOR EXECUTIVE ORDER No. 2016 —1 CREATION OF FLINT WATER INTERAGENCY COORDINATING COMMITTEE MICHIGAN DEPARTMENT OF STATE POLICE WHEREAS, Section 1 of Article V of the Michigan Constitution of 1963 vests the executive power of the state of Michigan in the Govemor, and WHEREAS, Section 2 of Article V of the Michigan Constitution of 1963 empowers the Governor to make changes in the organization of the Executive Branch or In the assignment of functions among its units that he considers necessary for efficient administration; and WHEREAS, municipal water in the City of Flint showed elevated lead levels after the City of Flint switched its water source to the Flint River; and WHEREAS, the County of Genssee and the City of Flint have taken actlons to cope with the situation, including but not limited to, switching back to the Detroit water system on October 16, 2016, declaring local states of emergency, activating the emergency response and recovery aspects of their emergency operations pian, marshaling and distributing required resources on a city-wide level, and issuing emergency public information and bulletins; and WHEREAS, the Flint Water Advisory Task Force was formed as an independent advisory task force charged with reviewing actions regarding water use and testing‘in Flint; and WHEREAS, the Flint Water Advisory Task Force has made an interim recommendation that the state government should coordinate a sustained, public-health focused response to remedy, to the fullest extent possible, the Impacts on the Flint community; and WHEREAS, on January 5, 2016, the Governor Issued a proclamation declaring a state of emergency in the County of Geneses and the City of Flint; and WHEREAS, multiple state departments and local authorities share the responsibility for ensuring safe drinking water and the coordination of efforts to address the consequences resulting from the presence of elevated lead levels in drinking water, and WHEREAS, ensuring safe drinking water and addressing the consequences of elevated lead levels in drinking water will require collaboration and communication between state departments, local governments, and subject matter experts; and WHEREAS, the establishment of a Flint Water Interagency Coordinating Committee within the Michigan Department of State Police will facilitate the collaboration and GEORGE W. Snyder, Govemor of the state of Michigan, by virtue of the power and authority vested In the Governor by the Michigan Constitution of 1963 and Michigan law, order the following: I. CREATION OF THE FLINT WATER INTERAGENCY COORDINATING CONMITTEE A The Flint Water Interagency Coordinating Committee (“Coordinating Committee”) is created as an advisory body within the Michigan Department of State Police (the “Department’). B. The Coordinating Committee shall be composed of the following seventeen (17) members who shall serve an initial term expiring on December 31, 2018. e The Director of Office of Urban Initiatives within the Executive Office of the Governor; e The Deputy State Director of Emergency Management and Homeland Security within the Michigan Department of State Pollce; e The Director of the Department of Environmental Quality, or his or her designees; ° re Director of the Department of Health and Human Services, or his or her lesignee; e The Director of the Department of Licensing and Regulatory Affairs, or his or her designee; e The State Treasurer, or his or her designee; © The Superintendent of Public Instruction, or his or her designee; e The elected Mayor of the City of Flint who shall be appointed to the Coordinating Committee by the Governor, e Three (3) additional representatives of the City of Flint who shall be submitted by oe Mayor of the City of Flint and appointed to the Coordinating Committee by the jovernor; © Three (3) representatives of Genesee County who shall be submitted by the Genesee County Board of Commissioners and appcinted to the Coordinating Committee by the Governor, and « Three (3) subject matter experts who shall be appointed to the Coordinating Committee by the Governor. After the initial appointments, members of the Coordinating Committee appointed under this subsection shall serve terms of three years. Cc. A vacancy on the Coordinating Committee occurring other than by expiration of a term shall be filled in the same manner as the original appointment for the balance of the unexpired term. A member may continue serving until his or her successor Is appointed. A member may serve successive terms if reappointed. xxxEND_PAGE:treasury01_b40_7317_7621_131 Ih. CHARGE TO THE COORDINATING COMMITTEE A. The Coordinating Committee shall act in an advisory capacity to the Governor and subject to the Governor's review and approval, shall do all of the following: 1. sa N @ 11. 12. B. Create an incident action plan designed to assist state and local authorities in ensuring safe drinking water for the residents of the City of Flint and addressing the consequences of elevated lead levels in drinking water. Review recommendations made by the Flint Water Advisory Task Force and propose statutory, regulatory, or contractual actlons necessary for Implementation of such recommendations. Identify staff with competencies In emergency planning, operations, logistics, and finance as outlined under the National Incident Management System (NIMS) to wark with the Coordinating Committee to track resource requests and document progress on the Incident action plan. Establish a standard process for sharing pertinent information between all members including use of the NIMS and Unified/Incident Command as appropriate. Establish routine communications protocols at the local, executive, and legislative levels as appropriate. Establish a public information protocol to effectively inform the community. Make recommendations for acceptable standards for potable water. Make recommendations regarding the health impacts for the affected population. Assess the status of Infrastructure and determine feasible actions to upgrade the water system. Establish subcommittees among its members to specifically address, at a minimum, each of the three following topic areas: Water Quality, Community Health, and Education. Assist the Govemor and the Department in implementing appropriate operations permitted under the Michigan Emergency Management Act or the federal Stafford Disaster Relief and Emergency Assistance Act, including local emergency operations plans and guides. Explore any avenues of funding for response and recovery efforts including federal grants, legislative appropriations, and private partners. The Coordinating Committee shall provide other Information or advica as requested by the Governor or the Department. xxxEND_PAGE:treasury01_b40_7317_7621_132 I, OPERATIONS OF THE COORDINATING COMMITTEE A The Coordinating Committee shall be staffed and assisted by personnel from the Department as directed by the Department Director. Any budgeting, procurement, and related management functions of the Coordinating Committee shail be performed under the direction and supervision of the Department Director. B. The Director of Office of Urban Initiatives within the Executive Office of the Governor and the Deputy State Director of Emergency Management and Homeland Security shall together serve as the Statewide Coordinators responsible for the administrative functions of the Coordinating Committes. Cc. The Coordinating Committee may utilize subcommittees and advisory panels composed of its members to assist In completing the functions of the Coordinating Committee. The Coordinating Committee may request public participation on advisory panels as the Coordinating Committee deems necessary. D. When making recommendations to the Governor, a majority of the serving members of the Coordinating Committee must concur. E. The Coordinating Committee shail meet at the call of either of the Statewide Coordinators and as may be provided in procedures adopted by the Coordinating Committee. F. The Coordinating Committee may, as appropriate to perform its duties, make inquiries, conduct studies, consult with outside experts and federa! agencies, and receive comments from the public. G. Members of the Coordinating Committee shall serve without compensation but may receive reimbursement for necessary travel and expenses according to relevant statutes and the rules and procedures of the Civil Service Commission, and the Department of Technology, Management and Budget, subject to available funding. H. The Coordinating Committee may accept donations of labor, services, or other Items of value from any public or private agency or person. Any donations shall be expended in accordance with applicable laws, rules, and procedures. : I. Members of the Coordinating Committee shall refer all egal, legislative, and media contacts to the Department. J. Awriting prepared, owned, used, in the possession of, or retained by the Coordinating Committee in the performance of an official function is subject to the Freedom of Information Act, 1976 PA 442, as amended, MCL 15.231 to 16.246. IV. MISCELLANEOUS A. Ail departments, committees, commissioners, or officers of this state or of any political subdivision of this state may give to the Coordinating Committee, or to any member or representative of the Coordinating Committee, any necessary assistance required by the 4 xxxEND_PAGE:treasury01_b40_7317_7621_133 Coordinating Committee, or any member or representative of the Coordinating Committee, in the performance of the duties of the Coordinating Committee so far as is compatible with its, hls or her duties. Weaver wants Flint to be declared a national disaster after local officials and the Michigan Department of Environmental Quality failed to use the appropriate test protocols to detect lead in the water customers have been using. Thousands of customers including pregnant women, seniors, school going children have been drinking the contaminated water that an independent research team from Virginia Tech confirmed has lead in it. which has become a mainstay for inclusive and racially diverse conversation on issues. Redline has netted some significant guests in broadcast interview whose appearance on the Detroit program was their first time on WDET. Rick Snyder announces Flint Water Task Force to review state, federal and municipal actions, offer recommendations Experts in public health, water management, environmental protection to focus on steps to protect residents LANSING, Mich. — Gov. Rick Snyder today announced the creation of an independent advisory task force charged with reviewing actions regarding water use and testing in Flint and offer recommendations for future guidelines to protect the health and safety of all state residents. Task force members include experts in public health and medicine, water management, and environmental protection from both sides of the aisle, and will be co-chaired by Ken Sikkema of Public Sector Consultants and Chris Kolb, of the Michigan Environmental Council. Also serving will be Dr. Matthew Davis of the University of Michigan Health System, Eric Rothstein, of the Galardi Rothstein Group and Dr. Lawrence Reynolds of Mott Children’s Health Center in Flint. “Transitioning back to the Detroit Water and Sewerage Department-Great Lakes Water Authority is a good first step to protecting public health in Flint, but it’s not the last step,” Snyder said. “Bringing in outside experts to evaluate our actions and help monitor and advise on potential changes to law, procedures and practices will be key to continuing work on the comprehensive action plan and ensuring safe drinking water for all the residents in Flint and all of Michigan.” Snyder said the administration will fully cooperate with task force members, saying he wants an unbiased report focusing on steps taken in the past and recommendations that could improve practices to ensure all residents have access to safe, clean water. Ken Sikkema is a senior policy fellow at Public Sector Consultants, where he specializes in public finance, environment, and energy policy. Prior to joining the firm, Sikkema served in both the Michigan House and 1 xxxEND_PAGE:executiveofficeemails20_b1135_2885_2886_1 Senate, culminating with four years as Senate majority leader. He has also served as both an adjunct and visiting professor at Grand Valley State University. Chris Kolb is president of the Michigan Environmental Council, a statewide coalition of 70 environmental, public health and faith-based nonprofit groups. Before joining the MEC, Kolb represented Ann Arbor in the state House for six years and served six years on the Ann Arbor City Council. He has been president of the MEC for six years. Matthew Davis, M.D., M.A.P.P., is professor of pediatrics and internal medicine at the University of Michigan Health System and professor of public policy at the Gerald R. Ford School at the University of Michigan, having joined the faculty in 2000. Davis also is a professor of health management and policy at the School of Public Health. He previously served as the chief medical executive of the Michigan Department of Community Health/Department of Health and Human Services. Eric Rothstein is a national water issues consultant and principal at the Galardi Rothstein Group. He served as an independent advisor on the creation of the Great Lakes Water Authority. Rothstein also has served as Jefferson County, Alabama’s rate consultant and municipal adviser for litigation related to the county's bankruptcy and issuance of $1.7 billion in sewer warrants and led strategic financial planning for the City of Atlanta’s Department of Watershed Management. He has more than 30 years of experience in water, wastewater and stormwater utility finance and rate-making assessments. Lawrence Reynolds, M.D., is a pediatrician in Flint who serves as president of the Mott Children’s Health Center. He received his medical degree from Howard University College of Medicine and has been in practice for 36 years. He has served as president of the Genesee County Medical Society and the Michigan Chapter of the American Academy of Pediatrics. He has been honored for his humanitarian and advocacy efforts on behalf of children from the Community Foundation of Greater Flint. Snyder has said reconnecting with the authority is a critical step to resolving water quality issues and addressing related health concerns. It will not immediately resolve the city’s problem with lead service lines or aging infrastructure. It will take time for pipes in Flint to become coated with the phosphate corrosion control. To best protect public health, state and local authorities will continue to carry out steps outlined on Oct. 2 ina comprehensive action plan, including continued testing, the use of faucet filters and providing residents with accurate information about steps to eliminate lead exposure.
