Many children in the City were found with elevated levels of lead in their blood, placing them in direct harm of the irreversible effects of lead poisoning. The City contributed two million dollars to a total cost of $12 million for the reconnection to Detroit, which was a safer source of water. The City seeks to recuperate this two million dollars while it faces financial challenges posed by this State of Emergency. Even though the City has progressed to strategically reduce deficits by seeking new millages, reducing staff, and reducing services, the City still faces critical financial obstacles. The City does nat have the financial stability to expend this level of resources. The FDCVT Grant is essential for the successful reimbursement of this project, which has contributed to improving the safety, reliability, and sustainability of the City’s water system, so that the City can continue operations in a time of financial stress. Water from the Flint River, the City’s water source, had been leeching lead from old pipes and solder, contaminating the water supply. Elevated lead levels in children were discovered by physicians at Hurley Hospital. Genesee County, the State of Michigan, and the United States Federal Government have elevated the emergency to their levels as well, The City of Flint is also currently in a state of fiscal distress at a time in which considerable dernands are placed upon it relating to the provision of clean and safe water. The City is attempting to cope with these demands, while revenues are down or drastically reduced. Even though the City has progressed to strategically reduce deficits by seeking new millages, reducing the number of city employees and related costs, and ultimately reducing the services to the public, the City continues to face critical financial challenges. Both the income tax and property tax revenue bases have declined by 55% since the economic downturn in 2008. The current resources available to the City are very restricted and limited. The City of Flint has been in receivership since December 2011. At that time, the State of Michigan Financial Review Team found that the City has a General Fund deficit of $14,621,546 as of June 30%, 2010, which was not eliminated within the two year preceding period. The City previously submitted a five year deficit elimination plan for a cumulative general fund deficit of $7,046,820 as of June 30", 2008, However, by June 30", 2010, the cumulative general fund deficit had grown to $14,621,546. An updated plan submitted for 2010 did not purport to eliminate cumulative deficit until 2030 and that relied upon the issuance of an additional $12 million of debt in 2013. A structural operating deficit existed in the general fund as of June 30, 2007, 2008, 2009, 2010, and the General Fund was projected to have a $6,768,864 deficit as of June 30, 2011. The Comprehensive Annual Financial Report for the fiscal year ended June 30, 2011 was received in December 2011. The City’s General Fund, which had a $14.6 million deficit at the beginning of the year, ended it with an $8.9 million deficit, The reduction in the deficit was due solely to an $8 million Fiscal Stabilization Bond issued by the city in March 2011. In total, excluding the impact of the FSB proceeds and the Genesee Towers judgment levy, expenses in the General Fund exceeded revenues. The City's Comprehensive Financial Report revealed an unassigned deficit in the General Fund of $8,961,427 as of June 30, 2014, which had resulted from operating deficits. The City does not have a current bond rating. The most recent bond rating was from over a decade ago and received a score of Bai, a qualifying indicator of fiscal distress. As part of a recent judgment, the City was ordered to repay its Water and Sewer Fund 15.7 million from its General Fund. The recent water challenges have also resulted a lower frequency of bill payments

This switch has resulted in elevated lead levels in drinking water which prompted both the City and the County Health department to issue a health advisory earlier this year. Mayor Weaver states that this was one of the things she had promised to do while campaigning for mayor. Declaring an emergency intends to help raise awareness of the issue that the water is still not safe to drink and activates the City’s Emergency Support Plan in order to respond to the crisis. On October 16 of this year, the City switched back to the Detroit Water and Sewerage Department as the source of water, however lead levels remain well above the federal action level of 15 parts per billion in many homes. Residents are advised to continue using water filters while long term solutions are being developed. City of Flint Dear Treasurer Khouri: We are writing to respectfully request financial assistance from the State of Michigan with the cost of defending the above-reference lawsuit. This is a class action that challenges water/sewer rates set by the City. The rates were established, in part, by Emergency Manager Michael K, Brown in 2011. The plaintiffs seek a 35% reduction in rates, as well as repayment of charges that were allegedly illegal. If successful, the financial impact would be catastrophic. Due to the gravity of the situation, and at the urging of Treasury officials, the City retained the law firm of Miller Canfield to handle its defense. Miller Canfield has an outstanding reputation and is well-suited to litigate this matter. However, a firm of this caliber is well beyond the financial means of the City of Flint. We are at a crossroads that requires careful consideration. We cannot afford to continue paying Miller Canfield, but equally cannot risk failure in this lawsuit. The lawsuit has already caused devastating financial harm to the City due to rulings by the court. In August, the court issued a preliminary injunction order that is striking in its breadth. Among other things, it compelled the City to reduce water rates by 35% pending the outcome of litigation, and prevented readiness to serve charges. Under the injunction, the City has been unable to collect past due water bills, leaving $11.6 million dollars of uncollected revenue. The City is losing over $600,000.00 per month, with many customers taking a wait-and-see approach to paying their bills. In a Hobbesian choice, the City was forced to abandon desperately needed capital improvements. This will further escalate costs and exacerbate infrastructure needs. In addition, Genesee County Circuit Court Judge Archie Hayman sue sponte ordered the City to repay $15.7 million dollars from its general fund to the water and sewer fund, on the perception that the money was wrongfully transferred. The court’s ruling have consistently been pro-plaintiff. Much of the legal work is focused on appellate review. Despite a hiring/spending freeze, the City will soon confront the difficult question of whether to use the general fund to pay for the water/sewer system. This would necessarily compel cuts in its already short-staffed police force. It is imperative the claims asserted in this case are confronted and reversed. The City needs a strong legal defense in this matter, as the consequences of not prevailing will be drastic. In August of 2015, the City retained Miller Canfield at the urging of State officials. At that time, it was suggested the State would provide financial support. Unfortunately, that support has been discussed for months, but not yet provided. Legal fees from Miller Canfield, to date, total more than $80,000. The cost of defending this matter is rapidly exhausting the City’s litigation reserves. We need help, or will not be able to continue with this level of defense. Under Public Act 436, the State does not assume liability for the actions of an emergency manager. However, we believe there are practical considerations that call for financial assistance. By ensuring the City has needed litigation resources, the State can guard against a return to emergency financial crisis in Flint. Without those resources, the risk of a catastrophic judgment substantially increases. Thus, helping Flint now is a prudent investment to avoid a more costly enterprise. Moreover, a substantial portion of this lawsuit relates to actions taken by an emergency manager under the careful watch of the State of Michigan. The City of Flint should not be left on its own to defend those choices. Over the past four years, the City has made enormous strides in attempting to rectify its financial crisis. Pain was broadly spread to current employees, retirees and residents. The City was forced to do more with substantially less. Our residents received reduced municipal services, but increased their volunteerism. Contrary to the perception of some, the City and its residents have met the challenge of regaining financial solvency issued by each of the four emergency managers appointed by Governor Snyder. We proudly closed fiscal year 2015 with a balanced budget. We have come far, but now confront a lawsuit that seriously threatens to undermine the enormous work, hardship and sacrifice of the past four years.
