| am not well versed on this matter as we have no prior history of such an event impacting a community public water system. The attached document was received by our Noncommunity Public Water Supply program manager (Dana DeBruyn) at a presentation given by Deborah Garcia, Public Health Administrative Law Specialist who works in the Office of Legal Affairs and FOIA, formerly in DCH, now DHHS. It seems like the authority used by Genesee County falls under the first Action of Imminent Danger Order. The fourth bullet implies that the Director (of DHHS?) may take full charge of the situation including the oversight of local health laws, rules, regulations and ordinances. It doesn’t appear to place any particular onus or responsibility on the DEQ Director. Perhaps we need legal advice.
